As the number of satellites orbiting the Earth grows at an exponential rate, the danger of uncontrolled space collisions is transforming into a real threat to future space activities. Any violent impacts between spacecraft threaten to generate extensive debris fields, rendering entire orbital zones completely useless. Although major incidents remain historically rare, the picture above the atmosphere has changed dramatically. Today, more than 18,000 active and inactive satellites in orbit are tracked, a figure that has more than doubled in just the past six years. The vast majority of these objects are crowded into Low-Earth Orbit, where increasing congestion statistically heightens the probability of accidents.
New requirements for real-time data
To prevent such a scenario, the US Federal Communications Commission (FCC) moved unanimously to adopt a new rule framework aimed at modernizing licensing and enhancing space safety. A pivotal element of the new regulations is the requirement for satellite operators to share accurate, real-time tracking data. Until now, predicting potential collisions relied on limited data from ground-based telescopes and radar, which suffer from notable "blind spots." At the same time, private companies avoided sharing their proprietary data due to concerns over privacy and the protection of trade secrets. Now, sharing information with approved governmental or private entities monitoring space traffic management becomes mandatory, eliminating uncertainty in risk assessments.
Power struggle in Washington
While the technical specifications themselves enjoy broad acceptance across the industry, the initiative by the FCC has reignited a political dispute regarding who holds the authority to establish rules in space. The FCC has de facto acted as a regulator due to its authority over radio frequency spectrum allocation. However, lawmakers from both parties—among them Republican Brian Babin and Democrat Zoe Lofgren of the House Science Committee—argue that this responsibility should be transferred to the US Department of Commerce, questioning the FCC's legal foundation to regulate space traffic matters. Despite pressure from lawmakers to postpone, the commission proceeded normally with the vote.
A breath of fresh air for startups
Despite the bureaucratic backdrop, the commercial space industry views these changes in a highly positive light. The new framework replaces outdated and time-consuming approval procedures spanning decades with flexible, performance-based rules, significantly accelerating licensing timelines. Furthermore, the reform is expected to reduce prohibitive barrier-to-entry costs for smaller startups, which until now were required to post performance bonds of up to $10 million to secure a license—an amount affordable for giants like SpaceX or Amazon, but unthinkable for new entrepreneurs. As industry executives point out, time is pressing relentlessly while companies plan the deployment of massive mega-constellations containing thousands of new satellites. "It's a big neighborhood up there," emphasize industry actors, "and if something goes wrong, the impact affects everyone."
